Gran Scala might be unconstitutional

25.06.2009, The legal services of the Aragon Courts (sp.Cortes de Aragón) has evaluated the Law of Leisure Centers of High Capacity in a report which, among other things, doubts that this kind of projects may be considered 'in public and social interests', in order to expropriate land.

Moreover, a question arises concerning the constitutionality of this law, so it allows Government to expropriate private land if 80% of the land for the building had been acquired by developers. This assessment is repeated up to three times in 19 pages, pointing out that the Government of Aragon must be specified minor infringements in these kinds of projects. According to the current Spanish law, it "violates the principles of legality and criminality”.

In total, the report includes 48 legal corrections to the law (of 40 articles), of which only 13 were accepted and purely formal.

The legal services of the Aragon Courts had also others questions, regarding the gaming rules, made specific for this project and different to the regional.

Another point of conflict refers to the figure of the consortium, consisting of different government institutions. The report remarked the poor regulation of the statutes of this consortium.

The other corrections relate to formal error in documentation and asking to take into account the approved Town and Country Planning Act and Act of Tourism.
